Ranch and Realty (“Ranch and Realty”, “we”, “us”, or “our”) is a real estate brokerage serving Southeast Colorado, including Lamar, Springfield, and surrounding counties. We focus on residential, commercial, farm, ranch, and land properties.
Our goal is to help buyers, sellers, investors, and landowners:

Evaluate properties and market conditions; and
Complete real estate transactions in a professional, honest, and efficient way.
These Terms of Use (“Terms”) explain the rules for using our website, tools, online forms, client portals, and any related online services we provide (together, the “Services”). By visiting our website, filling out a form, creating an account, or using any part of our Services, you agree to these Terms and to our Privacy Policy.
If you do not agree to these Terms, please do not use our Services.

4.2 No Offer or Agency Created by Website
Nothing on our website is an offer to sell or buy real estate. A binding agreement for the purchase or sale of property will only be created through a written contract signed by all required parties and accepted according to applicable law.
Viewing our website, using our tools, or contacting us through the website does not, by itself, create a brokerage, agency, or client relationship. Any such relationship will be created only through a separate written agreement as required by Colorado law and applicable regulations.
4.3 Market Data and Tools
Any market data, estimates, calculators, or tools on our website are for general informational purposes only. They:
May be based on public records, third-party data, or assumptions;
May not reflect current market conditions; and
Should not be relied on as a formal appraisal, valuation, or guarantee of price or performance.

To the extent we are found liable for any claim arising out of or related to the Services, our total liability to you will not exceed one hundred U.S. dollars (US $100), unless a higher amount is required by applicable law.
Some jurisdictions do not allow certain limitations of liability, so some of the above limits may not apply to you. In that case, our liability will be limited to the smallest amount allowed by law.

You agree to indemnify, defend, and hold harmless Ranch and Realty and its brokers, agents, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

We may, at our own expense, assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that case, you agree to cooperate with our defense of that claim.

We may update these Terms from time to time. When we do, we will change the “Last Updated” date at the top of this page. Changes are effective when posted on the website.
If you continue to use the Services after we post updated Terms, you agree to the new Terms. If you do not agree, you must stop using the Services.
We may also, where required by law, provide additional notice of material changes (for example, by email or a notice on the website).
12. Governing Law and Disputes
These Terms and any dispute arising out of or related to your use of the Services will be governed by the laws of the State of Colorado, without regard to its conflict of law rules.
Any legal action or proceeding between you and Ranch and Realty arising out of or related to these Terms or the Services shall be brought only in the state or federal courts located in Colorado. You consent to the personal jurisdiction and venue of those courts.

We may, at any time and without notice, suspend or terminate your access to the website or Services if:
You violate these Terms or applicable law;
We believe your use may harm us, our clients, or others; or
We decide to discontinue or limit the Services.
You may stop using the Services at any time. Sections that by their nature should survive termination (including, but not limited to, Intellectual Property, No Warranty, Limitation of Liability, Indemnification, and Governing Law) will continue to apply even after your use ends.
14. Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy and any written brokerage or agency agreements you sign with us, form the entire agreement between you and Ranch and Realty regarding your use of the Services.
Severability: If any part of these Terms is found invalid or unenforceable, the rest will remain in full force and effect.
No Waiver: Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations as part of a sale, merger, or other business change.
